Terms for Ammunition Sales

 

1.

Kalahari Arms sells quality ammunition procured from various suppliers and licensed manufacturers. Nevertheless, the following are relevant issues:

1.1

It is known that not all ammunition is well suited to all firearms and that semi-automatic firearms may not function reliably with all ammunition, even though of the correct calibre.

1.2

It is the Customer’s sole responsibility to determine that any ammunition supplied by Kalahari Arms is compatible with their particular firearm(s).

1.3

Ammunition may degrade over time, a process exacerbated by fluctuations in temperature and moisture.

2.

Kalahari Arms encourages qualifying Customers to buy ammunition in bulk, through quantity discounts, and wishes to offer Customers peace-of-mind with these purchases. Within 90 days of purchase, should you find that any ammunition you bought from us is unsuitable for your firearm(s):

2.1

We will gladly exchange any unused, unopened, undamaged boxes of ammunition for alternative brands, weights, shapes or options.

2.1.1

Several “Boxes” are normally included in a “case lot”, when buying in bulk.

2.1.2

It is acceptable to return unopened “case lots”, and/or unopened “boxes” of ammunition.

2.1.3

Loose cartridges and/or partial boxes cannot be accepted for return.

2.2

When offering the Customer alternative ammunition, the exchange will be made on a value for value basis and not quantity for quantity.

2.2.1

The customer may accept a different quantity of the alternate ammunition to closely match the value of the returned ammunition.

2.3

Any price adjustment will be made, whether requiring refund by Kalahari Arms or pay-in by the Customer.

2.4

In line with our policy on Backorders and Special Orders, special orders and/or custom orders of ammunition are NOT refundable, and can NOT be cancelled.-Priced may vary at any time

2.4.1

Special orders refer to ammunition brands, calibres, weights, shapes, etc. that Kalahari Arms does not normally stock, and that you request us to procure for you.-only to be placed once receipt of a non refundable deposit

2.4.2

Custom orders refer to ammunition that you request us to procure for you from a commercial ammunition manufacturer where this ammunition has been loaded to your specifications, whether or not Kalahari Arms has assisted, consulted or advised in these specifications. only to be placed once receipt of a non refundable deposit

2.5

The Firearms Control Act (FCA) limits or restricts the quantity of ammunition that a person may possess. 

2.5.1

Kalahari Arms will only supply ammunition to the holder of a valid firearm license where the licensed firearm is suitable to discharge said ammunition.

2.5.2

Unless you are a “dedicated person”, Kalahari Arms will supply a maximum of 200 cartridges against any particular license issued under the FCA. – remove

3.

Kalahari Arms is not responsible for any damages or injury sustained through using ammunition supplied by Kalahari Arms, but will gladly assist Customers in addressing such claims with the applicable manufacturer.

 

 

 

Legal Constraints when buying Ammunition

Defined by FCA, Act 60 of 2000

 

Ammunition is defined and governed by the Firearms Control Act (FCA), Act 60 of 2000 as amended. For convenience we have copied the relevant sections below.

Please note:

1.

Pellets, darts, projectiles and inert training ammunition (a.k.a. snap caps, dummy rounds) are unrestricted and may be freely ordered in any quantity with or without a firearm license.

 

 

 

 

2.

Should you order cartridges (a.k.a. live ammunition) from Kalahari Arms, we require proof of your license(s) for a firearm(s) capable of discharging that ammunition.

 

a.

We need the license information when you collect, or before we can ship these goods.

 

b.

You can send a copy to us via e-mail or WhatsApp.

 

c.

We’ll shortly provide the opportunity to upload this information to your secure Kalahari Arms account.

 

 

 

 

3.

Restrictions on Ammunition

 

a.

In terms of Section 91(1) of the FCA, Kalahari Arms may supply no more than 200 cartridges at any one time, per firearm license, to “occasional” firearm owners,

 

 

i.

Most firearm owners would likely fall into this category

 

 

ii.

If you hold a section 13 (self-defense) and/or section 15 (occasional sport shooting / hunting) license and/or section 17 (private collector) license and/or Section 18 permit to collect ammunition.

 

 

 

 

 

b.

In terms of Section 91(2)(a) of the FCA, this limit does not apply if you are “dedicated”, i.e. a dedicated sport shooter, dedicated hunter or professional hunter. You may buy as many primers as you need.

 

 

i.

We accept Section 16 or 16A “white” licenses as proof of dedicated status.

 

 

ii.

We also accept proof of dedicated status from your accredited association, even if you don’t have a section 16 “white” license.

 

 

iii.

Old “green” licenses issued under the Arms and Ammunition Act are still valid (ref: SA Hunters Court Case), and have no quantity restrictions associated with them.

 

 

 

 

 

c.

If you hold a permit to possess more ammunition, issued in terms of Section 91(2)(a) of the FCA, please supply us with a copy of that permit when purchasing more than the restricted quantity.

 

 

 

 

4.

Should we detect that you have ordered items in contravention with our policies or any law, we will contact you to resolve the issue. So, don’t worry if all this sounds complicated – Kalahari Arms will help you to do things right!

 

 

 

 

We draw your attention to the following definition(s) and section(s) in the Firearms Control Act, Act 60 of 2000 as amended. Our emphasis has been added.
ammunition” means a primer or complete cartridge;

 

 

 

 

90.

Prohibition of possession of ammunition
No person may possess any ammunition unless he or she –

 

a)

holds a license in respect of a firearm capable of discharging that ammunition;

 

b)

holds a permit to possess ammunition;

 

c)

holds a dealer’s license, manufacturer’s license, gunsmith’s license, import, export or in-transit permit or transporter’s permit issued in terms of this Act; or

 

d)

is otherwise authorized to do so.

 

 

 

 

91.

Restrictions on possession of ammunition

 

1)

The holder of a license to possess a firearm referred to in Chapter 6 may not possess more than 200 cartridges for each firearm in respect of which he or she holds a license.

 

2)

The limitation in subsection (1) does not apply to –

 

 

(a)

a dedicated hunter, dedicated sports person or a professional hunter who holds a license issued in terms of this Act or any other holder of a license issued in terms of this Act authorized by the Registrar to possess more than 200 cartridges for a firearm in respect of which he or she holds a license on good cause shown; or

 

 

(b)

the holder of a license to possess a firearm issued in terms of this Act in respect of ammunition bought and discharged at an accredited shooting range.

 

 

 

Legal Constraints when buying Firearms

Defined by FCA, Act 60 of 2000

 

Take note of the following process, especially if you are buying your first gun:

1.

You must first complete the prescribed proficiency training for the type(s) of firearms you want to procure. The training would cover the law, plus one or more of the following modules: Handgun, Shotgun, Rifle, Self-Loading rifle

 

a.

For all your training requirements , please contact us in store for more information   

 

b.

To save time in future, we suggest you complete as many of the modules as possible right away. Since they are formal qualifications, these never expire.

 

 

 

2.

With your Proficiency Certificate(s) you can then apply to the SAPS for a Competency Certificate.

 

a.

The Competency Certificate is considered your personal permit to possess a type, or several types, of firearm, i.e. Handgun, Shotgun, Rifle, Semi-auto rifle.

 

b.

Expect this process to take around 3 months, possibly longer.

 

c.

To save repeating this process in future, we suggest you apply for Competency in as many of the modules as possible, right away.

 

d.

We don’t offer formal assistance with preparing application forms, but we can refer you to specialists.

 

 

 

3.

Once you have your Competency Certificate, you can then apply for your firearm license

 

a.

Your firearm license is your permit to possess the specific firearm you have selected and bought. Your firearm licence if your only legal tender to possessing and carrying your specific firearm.  

 

b.

Kalahari Arms will supply you with the SAPS 271 license application forms, with our details and the firearm details included.

 

c.

Expect this process to take around 3 months, possibly longer. Lisencing and the processing thereof falls soleing under the prevue of the SAPS and your local DFO (District Firearms officer)

 

d.

While we do offer guidance, we don’t offer formal assistance with preparing the application forms, but we can refer you to specialists.

 

 

 

4.

You can collect the firearm from us, or we can ship it to you or a registered firearm dealer near you, only once you have received the actual license card from the SAPS.

 

a.

Bring the card with when you collect.

 

b.

Should you require a firearm or ammunition to be shipped, please refer to the Shipping terms and conditions

 

 

 

5.

Quantity restrictions on firearms are managed via the firearms licensing process. You may buy all the firearms you desire, but Kalahari Arms may only hand them over on production of a valid firearm license CARD for each specific firearm.

Overview

Our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Several types of goods are exempt from being returned. Perishable goods such as food, flowers, newspapers or magazines cannot be returned. We also do not accept products that are intimate or sanitary goods, hazardous materials, or flammable liquids or gases.

Additional non-returnable items:

  • Gift cards
  • Downloadable software products
  • Some health and personal care items

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted:

  • Book with obvious signs of use
  • CD, DVD, VHS tape, software, video game, cassette tape, or vinyl record that has been opened.
  • Any item not in its original condition, is damaged or missing parts for reasons not due to our error.
  • Any item that is returned more than 30 days after delivery

Refunds

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

If you’ve done all of this and you still have not received your refund yet, please contact us at {email address}.

Sale items

Only regular priced items may be refunded. Sale items cannot be refunded.

Exchanges

We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at {email address} and send your item to: {physical address}.

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and they will find out about your return.

Shipping returns

To return your product, you should mail your product to: {physical address}.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you may vary.

If you are returning more expensive items, you may consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Conditions of Sale – Updated 2020

THE PURCHASER AGREES TO THE FOLLOWING CONDITIONS OF SALE, WHICH
HAVE BEEN EXPLAINED AND UNDERSTOOD:
1. It is the purchaser’s responsibility to comply with the firearm laws in submitting the
application for the license for this firearm.
2. It is essential for the customer to divulge full and true details to us at the time of
purchase, so that we may give the best advice regarding the license application.
Should false information be given to us, we reserve the right to cancel this contract
with no refund.
3. This Contract of Sale is subject to a non-refundable deposit of 50% of the value of the
goods. The balance must be paid within 3 months from the date of signature. We
reserve the right to charge a storage fee of 2,5% of the value of the goods listed
above, per month.
4. The purchaser must provide us with proof of their License application, in the form of
the receipt as issued by the SAPS, within 3 months of the date of this contract, failure
to do so will double the monthly storage fee, to 5% of the value of the goods. Should
a license application not be submitted to the SAPS within 6 months from the date of
purchase, we reserve the right to cancel this Contract and sale with no refund.
5. Further to, and taking into account conditions 3 and 4 above, should the goods not be
collected within 6 months of purchase date, a storage fee of 2,5% of the value of the
goods will be charged after 6 months.
6. Should a customer decide to cancel this sales contract for any reason whatsoever, we
will re-sell the goods on their behalf. A re-stocking/admin fee of 5%, plus the original
15% VAT, will be deducted from the re-sale value of the goods, and the balance will be
refunded after the goods are re-sold.
7. The purchasers warrant that they have the requisite Competency Certificate, or will
obtain the relevant Certificate prior to submitting their License application to the DFO.
8. This contract is not transferable to third parties.
9. The purchaser hereby indemnifies the seller from any claim for compensation arising
from any damages or any cause howsoever arising, including but not limited to the
use, accidental use, latent or patent defects, or from any other cause whatsoever, and
agrees and undertakes to hold the seller harmless against any such claim albeit arising
in the past, present or future.
